Our services encompass the Docseek website accessible at https://docseek.ai, mobile and web applications, video and audio communication features, AI-powered health assessment tools, and all associated functionalities, content, and technologies (collectively referred to as the "Services").

By engaging with any aspect of our Service, including but not limited to clicking any button or checking any box marked "I agree," creating an account, initiating a health consultation, submitting health queries, or otherwise accessing or using our website, applications, or Services, you enter into a binding legal agreement with Docseek AI (referred to as "we," "us," or "Docseek"). Through these actions, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, modified, amended or updated by Docseek periodically. Your use of our Services also constitutes your consent to the collection and use of your information as set forth in our Privacy Policy, available at https://docseek.ai/privacy.

These Terms are applicable to all users of our platform, whether you are a user seeking health insights, a healthcare professional utilizing our services, or any individual accessing our resources. Should you disagree with any provision contained herein, you must discontinue use of our Services immediately. We reserve the right to update these Terms to reflect changes in our Services or legal requirements.

Consent

By accessing and using Docseek's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Permitted Usage Requirements

Solely for communication with healthcare providers

You may only use Docseek Services to facilitate communication with licensed physicians. You may not use Docseek Services unless you have an established primary care physician with whom you will promptly review all information provided by Docseek.

You agree to represent and warrant that all information you provide to Docseek is true and accurate. You must always discuss all Docseek-provided information with your doctor before making any medical decisions.

Docseek is an AI-powered health information platform that connects users with licensed healthcare providers. We do not practice medicine, provide medical diagnoses, or offer treatment recommendations. Docseek is not a doctor.
Docseek does not guarantee accuracy or correctness of its output. Users understand that all information discussed with Docseek must be verified with a qualified healthcare provider. The Services, Content, and Apps provided by Docseek are not to be construed as medical advice, instruction, diagnosis, treatment, or care. Always consult with qualified healthcare providers or licensed physicians regarding any outputs of Docseek. In case of a medical emergency, contact your local emergency services immediately.

Emergency and Crisis Situations

DOCSEEK IS NOT FOR EMERGENCIES

If you are experiencing a medical emergency, call your local emergency services or go to your nearest emergency room immediately.
Docseek is expressly prohibited for use in emergency medical situations, mental health crisis, suicidal ideation, thoughts of self-harm or violence, psychiatric emergencies, acute life-threatening symptoms, or any situation requiring immediate medical intervention.

Our AI system may automatically terminate conversations and direct users to appropriate emergency resources if prohibited content is detected. We reserve the right to immediately suspend user accounts without notice for such violations.

Use Limitations: Docseek is not intended for pediatric emergencies, pregnancy complications, or specialized medical conditions requiring specialist care (oncology, cardiology, neurology, autoimmune diseases, or rare disorders). Users under 18 are prohibited from using our services.

Products and Services

Docseek may display or reference third-party goods, services, healthcare providers, or medical products ("Third-Party Products"), including listings, descriptions, images, and links. Such information does not imply Docseek's endorsement, approval, or affiliation with any Third-Party Product or provider, and is provided for informational purposes only.

Content provided by healthcare professionals or medical practitioners through our platform does not create a doctor-patient relationship or professional medical relationship. Such content does not constitute medical opinion, advice, diagnosis, or treatment recommendations, and is provided strictly for informational and educational purposes only.

User Responsibility

You agree to use Docseek's services responsibly and in accordance with these guidelines:

  • Provide accurate information when prompted
  • Consult licensed healthcare providers on any information received from Docseek
  • Understand that delays in seeking proper medical care may result in serious harm
  • Docseek bears no liability for such delays or harm
  • Recognize that Docseek cannot replace in-person medical evaluation when required
  • Avoid using Docseek as the sole source of medical information or guidance
  • Refrain from making significant health decisions based solely on Docseek information

Access to Docseek Services is contingent upon meeting eligibility requirements and adhering to these Terms. Certain functionalities may necessitate account registration. Users bear sole responsibility for maintaining the confidentiality of their account and passwords. By creating an account, users accept full responsibility for all activities conducted under their account.

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal health information is governed by our Privacy Policy, which forms an integral part of these Terms. All information submitted through our Services is subject to the provisions outlined in Docseek's Privacy Policy.

By using Docseek, you consent to the processing of your health data as described in our Privacy Policy, including sharing your information with your chosen healthcare providers as needed for your care, receiving health information from those providers or systems where you have authorized it, and securely storing and processing this information in accordance with our Privacy Policy and Singapore’s Personal Data Protection Act (PDPA).

Docseek may create non-identifiable "aggregated or pooled data" using data complied by users of docseek. This data is de-identified and will not be traced back to any individual user. If you do not agree with our Privacy Policy or these data handling practices, you should discontinue use of our Services immediately.

Intellectual Property Rights

The Service is owned and operated by Docseek. All content, software, algorithms, medical databases, diagnostic tools, and other materials contained in the Service, including all trademarks, copyrights, and intellectual property rights, are and will remain the exclusive property of Docseek or our licensors.

You may use the Service solely for your personal, non-commercial healthcare purposes as intended. You may not copy, modify, distribute, sell, or create derivative works from any part of our Service or proprietary technology without our express written consent.

Rules of Conduct

Users are expressly prohibited from engaging in the following activities:

  • Disrupting, interfering with, or compromising the functionality or security of the Services
  • Harvesting, gathering, or collecting personal information about other users of the Services
  • Preventing, limiting, or hindering other users' access to or use of the Services
  • Utilizing the Services for commercial gain or business purposes without explicit written authorization from Docseek
  • Attempting to circumvent our security measures or access unauthorized areas
  • Attempting to reverse engineer, disassemble, or decode any components of the Services
  • Uploading, transmitting, or sharing content that is malicious, inappropriate, defamatory, offensive, or unlawful

Electronic Communications Consent

By utilizing our Services, users expressly consent to receive electronic communications from Docseek, as detailed in our Privacy Policy. Users acknowledge and agree that all notices, agreements, disclosures, terms, and other communications transmitted electronically by Docseek shall fulfill any legal requirements for written communication and shall be legally binding.

Non-Secure Communications Acknowledgment

Docseek communicates with users through various channels including email and text messaging. Users acknowledge and understand that these communication methods are not secure transmission channels, and Docseek cannot guarantee the security, confidentiality, or privacy of information transmitted through these means.

By continuing to use our Services, users accept the inherent risks associated with non-secure communications and waive any claims against Docseek regarding unauthorized access to communications sent via these channels. Users who are unwilling to exchange personal health information through these communication methods should discontinue use of our Services immediately.

Data Breach Notification

In the event of a data breach affecting your personal information, Docseek will notify you and relevant authorities in accordance with applicable laws and regulations, typically via email. Notifications will include the nature and scope of the breach, types of data affected, immediate steps taken to contain the breach, potential risks to you, and recommended protective measures. You acknowledge that notification timing may vary based on investigation requirements, coordination with authorities, and the need to implement immediate security measures.

Third-Party Materials and Links

Our Services may provide access to information, data, content, and materials made available by external parties ("Third-Party Materials"). Your access to and utilization of such third-party materials is undertaken entirely at your own risk and remains subject to any additional terms, conditions, policies, and restrictions applicable to such materials.

Disclaimer: No Warranties

Our services and materials are provided on an "as is" and "as available" basis without warranties or conditions of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Docseek and its affiliates shall not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, business interruption, or adverse health outcomes, arising out of or in connection with your use of the Services—regardless of the legal theory under which such liability is asserted, and even if Docseek has been advised of the possibility of such damages.

In no event shall Docseek's total aggregate liability to you for all claims arising from or related to the Services exceed the greater of Singapore ten dollars (SGD $10) or the total amount you have paid to Docseek in subscription fees during the twelve (12) months preceding the event giving rise to the claim.

Medical Practice Liability Disclaimer: You explicitly acknowledge and agree that Docseek does not establish a doctor-patient relationship, does not practice medicine, and cannot be held liable for medical malpractice of any kind. You further agree that Docseek bears no responsibility for any harm, injury, or adverse outcomes resulting from delayed medical care, misinterpretation of information provided through our Services, or failure to seek appropriate in-person medical evaluation when warranted.

Indemnification

You agree to indemnify, defend, and hold harmless Docseek, its affiliates, and their respective agents from and against any claims, demands, liabilities, losses, damages, costs, and expenses (including legal fees) arising out of or related to:

  • Your access to or use of the Services
  • Your violation of these Terms of Service
  • Your interaction with any advice given through the Services
  • Your violation of any law, regulation, or third-party rights, including but not limited to intellectual property, data protection, or privacy rights
  • Your reliance on or misuse of any information obtained through the Services

Modifications to Terms

Docseek reserves the right to modify, update, or change these Terms of Service at any time and for any reason, including but not limited to changes in our services, legal requirements, or business operations. We will notify users of such changes by posting a revised agreement through our Services or on our website. Your continued access to or use of Docseek Services following any modifications to these Terms will constitute your binding acceptance of such changes.

Termination and Service Modification

These Agreement remain effective until terminated by either party. Docseek reserves the right to terminate, suspend, or restrict your access to our Services at any time, with or without prior notice, for any reason including but not limited to violation of these Terms or applicable laws.

Data

By submitting or providing any data, content, or information through our Services, you grant Docseek a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sublicensable, and transferable license to use that data for the provision and improvement of our Services.

You represent and warrant that you either own the data or have all necessary rights and permissions to grant the license described above. You remain solely responsible for any data you provide, and for ensuring that such data does not violate any applicable law, regulation, or third-party rights, including intellectual property or privacy rights.

Your submission of data is also subject to our Privacy Policy, which explains how we collect, use, and disclose personal data in accordance with the Personal Data Protection Act 2012.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles. The courts of Singapore shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Services. If you access the Services from outside Singapore, you acknowledge that Singapore law governs your use and you submit to Singapore jurisdiction.

Before commencing legal proceedings, you agree to first attempt to resolve disputes through direct negotiation with Docseek, and if unsuccessful after 30 days, participate in mediation administered by the Singapore Mediation Centre.

Exception for Urgent Relief

Nothing in this clause permits either party to pursue monetary damages, health-related injury claims, privacy-related complaints, or wrongful death actions in any forum outside of Singapore.

Urgent injunctive or equitable relief may only be sought in another jurisdiction by Docseek solely to prevent imminent and irreparable harm resulting from the unauthorized use, disclosure, or misuse of Docseek's intellectual property, trade secrets, or confidential information.

Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Docseek regarding the Services and supersede all prior or contemporaneous communications and proposals.

Force Majeure

Docseek shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, war, terrorism, labor disputes, or failures of internet infrastructure.

Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without Docseek's prior written consent. Any attempted assignment or delegation without such consent will be null and void.

Survival

Provisions relating to intellectual property, confidentiality, data, limitation of liability, indemnification, and governing law shall survive termination of these Terms.

Violation of Terms

Any violation of these Terms of Service may result in the immediate suspension or termination of your access to Docseek, and/or the deletion of your account, without prior notice. Docseek reserves the right, in its sole discretion, to determine what constitutes a violation of these Terms. Our systems may automatically detect and respond to suspected violations by taking actions including, but not limited to, terminating individual sessions, restricting certain features, suspending accounts, or permanently disabling access. No refunds will be issued for any services terminated due to a violation of these Terms.

Geographic Limitations

Docseek is developed and operated in accordance with the laws and regulations of Singapore, including the Healthcare Services Act 2020 and the Personal Data Protection Act 2012. While users located outside Singapore may access the Services, Docseek makes no representations or warranties that the Services are appropriate, lawful, or compliant with healthcare, telemedicine, or data protection regulations in jurisdictions outside Singapore. Users accessing the Services from outside Singapore do so at their own initiative and are solely responsible for ensuring that their use complies with all applicable laws, regulations, and standards in their jurisdiction. Docseek disclaims all liability for any use of the Services that violates local law outside of Singapore.

Disclaimer for Users Outside Singapore

This application is developed and operated under the laws and medical regulations of Singapore. By accessing or using Docseek from outside Singapore (including but not limited to Malaysia, Indonesia, Myanmar, or the Philippines), you acknowledge and agree to the following:

  • Jurisdiction & Governing Law: All Services are offered in accordance with the licensing and healthcare regulations of Singapore. Use of the platform in other jurisdictions is governed solely by Singapore law and may not meet the healthcare, licensing, or telemedicine standards applicable in your country.

  • Informational Use Only: Our AI health tools, chatbot responses, and virtual consultations are provided for informational and educational purposes only. They are not a substitute for medical diagnosis, treatment, or care from a licensed healthcare provider in your jurisdiction.

  • No Emergency or Prescriptive Care: The platform does not provide emergency care. Prescriptions or medical certificates may not be valid or provided in countries where our providers are not licensed to practice.

  • User Responsibility: You are solely responsible for ensuring that your use of the Services complies with all local laws and regulations, including but not limited to those relating to telemedicine, healthcare licensing, and cross-border data sharing.

  • Data Privacy: Your health data is collected, processed, and stored in accordance with Singapore’s Personal Data Protection Act (PDPA). You acknowledge that these practices may differ from those in your jurisdiction (e.g., Malaysia PDPA, Indonesia PDP Law).

  • Limitation of Liability: By continuing to use Docseek from outside Singapore, you agree that Docseek and affiliated healthcare providers shall not be held liable for any regulatory, legal, or medical consequences arising from such use.

Permanent Bans and Prohibited Re-Registration

Any user who has been permanently banned or had their access to Docseek revoked for violating these Terms of Service is strictly prohibited from re-accessing or using the Services in any form. This includes, but is not limited to, creating a new account using a different email address, registering under an alternate identity, or accessing the Services anonymously or through a third party. If Docseek determines, at its sole discretion, that a banned user has attempted to regain access—regardless of whether any new violations have occurred—Docseek reserves the right to immediately suspend or terminate the account without notice and may take any necessary measures to enforce this restriction, including tracking and blocking associated accounts or IP addresses.

Billing Dispute Resolution

If you have any concerns regarding billing or payment, you agree to contact Docseek's support team at support@docseek.com before initiating any chargeback or dispute with your financial institution. We aim to resolve billing issues within seven (7) business days in good faith. Docseek reserves the right to suspend or terminate accounts that file chargebacks we reasonably believe to be fraudulent, abusive, or submitted in bad faith.
